Water Drainage Variance - 4112 Rosemary Street, 7 p.m.

A public hearing will be held by the Town’s Water Drainage Board, via Zoom (information attached or available on the Town website calendar), on Thursday, June 30, 2022 at 7:00 p.m. to consider the variance request of Charles and Elizabeth Jacobs, contract purchasers of 4212 Rosemary Street. The applicants propose to construct a new house and driveway at that address.
The Town’s Water Drainage Ordinance (Chapter 28 of the Town Code) does not allow the Town to issue a building permit for the proposed project without either an approved water drainage plan, or an approved variance from the Water Drainage Ordinance. The applicants claim that there are engineering difficulties that preclude a design which retains the required volume of runoff on the property as required by the Town’s ordinance.
The Town Water Board may only grant a variance if the following conditions are met:
- There are engineering difficulties such that strict adherence to the requirements of this chapter would result in undue hardship to the applicant;
- The proposed variance would not be detrimental to any adjoining or nearby property, or any public right of way; and
- The proposed variance would, as nearly as practical, accomplish the intent and purpose of the water drainage ordinance.
At the public hearing, Town residents will have an opportunity to express their views regarding this variance request.
