As Mayor, I sent the following e-mail to all Council members on Friday, December 4 asking for their concurrence to transmit to the State Ethics Commission the proposed ordinance to amend the Town's ethics and election laws to require the filing of a certificate of candidacy and a financial disclosure form by all candidates at least seven days prior to a Town election. Two additional Town Criers will be sent with additional information.

As I am sure all of you have done, I have given great thought to the continued debate concerning the Town elections and ethics laws. I have reached the conclusion that the likelihood of a controversial spontaneous write-in campaign occurring in the future is so remote that the issue is not worth the significant Council, staff, and attorney time it continues to consume, as well as the amount of energy it is consuming with our residents. Although I may continue to believe that preserving write-in candidacy, as currently allowed by Town law, is the correct policy decision, I may decide to change my vote, in favor of the opposing arguments, to put this issue to rest.

I therefore make a motion to direct the Town attorney to provide the other version of the ordinance, which is attached, to the State EC now so that both versions can be considered by the State EC at their next meeting and we can have the State EC’s position on both drafts, before the Town Council takes action, whatever action that may be.

Ron explains that the State EC has provided a deadline of 12/9 for the Town to submit additional materials. With that deadline, my motion cannot wait for our Council meeting on 12/9. However, we could consider at the 12/9 meeting a motion to lift from the table Kathy’s previous motion, and I have provided an agenda item to do this, to introduce the other version, so that both versions would be placed on the same track for potential adoption.

Please let me have a second to this motion, and your comments and if seconded your votes by 4pm on Sunday, 12/6, so that Ron will be able to send on 12/7.
