Building Permit Process
The Building Permit Process gives a sequential overview of the Town's building permit and inspection process.
All Town building permits use the same basic permit form. Additional submittal requirements may apply depending on the nature of your project, as detailed below.

Submittal Requirements
- Pre-PAC application (If the proposed project involves construction of a new building greater than 500 sq. ft.; demolition of a main building; or adds 500+ s.f. to any floor of a building)
- Building Permit Application
- Full set of construction drawings/building plans
- Certified Gross Floor Area Calculation
- Building Site Plan & Construction Management Site Plan (2 copies each)
- Tree Protection Plan including affidavit and supporting documents, if necessary
- Tree Removal Permit Application (as needed)
- Application Fee and Performance Bond
- If project adds 700+ square feet of impervious surface area, you must submit a Water Drainage Plan, including supporting documents.
If the proposed project involves new construction, demolition, or adds 500+ s.f. to any floor of a building, the Town must hold a site-management meeting prior to permit issuance. The Town will not approve a building permit application until a County Permit is issued.

- Full set of construction drawings/building plans
- Building Site Plan & Construction Management Site Plan (2 copies each)
- Tree Protection Plan including affidavit and supporting documents, if necessary.
- Tree Removal Permit (as needed)
- Application Fee and Performance Bond

Building Code Standards
Standards for Fences and Front Yard Hedges
The Town will not approve a building permit application for a new fence until a County Permit is issued. Montgomery
County does not issue permits for hedges or replacement fences.

No County Permit is required for a Dumpster/Container permit.
Variances
A variance is a deviation from the Town’s building code or water drainage ordinance that is allowed under certain circumstances. For example, you may want to build an addition onto your house that would violate the Town’s setback rules, or your proposed construction violates the Town’s water drainage ordinance. In such cases you would need a variance from the Town Code to proceed.
The Town Code is intended to be uniformly applied, but it recognizes that strict application in certain situations may create undue hardship. Variances give the Town some flexibility to address such unusual situations. Because of the serious consequences in granting a variance request, most such requests must be reviewed and decided by the Town Council. Certain of those that involve fences and walls, however, are handled as “administrative variances” and are reviewed and decided by the Mayor and Town Manager. Requests for variances from the Town’s Water Drainage regulations are heard and decided by the Town’s Water Board.

If you would like to amend an already existing house, accessory building or deck building permit, the following is required:
- Application for an Amended Residential Building Permit
- Copy of Amended County Permit
- Certified Copy of House Location Survey or Plat (with location of improvements noted)
- Plans and Specifications with proposed amendments clearly marked.
- Exact Description of Amended Construction Plans
- Application Fee of $200
If you would like to amend an already existing fence, wall, or hedge building permit, the following is required:
- Application for an Amended Residential Building Permit
- Copy of Amended County Permit (if applicable)
- Certified Copy of house Location Survey (with location of fence, wall, or hedge noted)
- Plans and specifications with proposed amendments clearly marked.
- Exact Description of Amended Construction Plans
- Application Fee of $50
